Welcome to EngKidz (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website at https://engkidz.com (the “Site”) and any products, services, or digital content we offer (collectively, the “Services” or “Products”). By accessing or using the Site or Services, you acknowledge that you have read, understand, and agree to be bound by these Terms and that you are at least 18 years old (or using the Site under the supervision of a parent/guardian). If you do not agree, stop using the Site and Services immediately.
1) Definitions
“Digital Content” means EngKidz Build & Learn videos, interactive guides, online simulations, and other online resources. “Downloadable Content” means PDFs and other files you can download (e.g., guides, activity sheets, safety instructions). “User Content” means photos, videos, reviews, testimonials, or other content you submit or share featuring EngKidz products.
2) Website Terms of Use
A. Accounts – If you create an account, you agree to provide accurate information and keep your credentials confidential. You are responsible for all activity under your account.
B. Permitted Use – Use the Site for personal, non‑commercial educational purposes only. Do not copy, reproduce, distribute, or modify Site materials except for your own learning use.
C. Intellectual Property – All Site and Product content (text, graphics, designs, videos, simulations, logos) is owned by EngKidz or its licensors. You may not use it for commercial purposes without written permission.
D. Acceptable Use – You agree not to upload or transmit unlawful, harmful, infringing, obscene, hateful, or otherwise objectionable content; malware or harmful code; spam or unauthorized advertising; or anything harmful to minors. Do not attempt to interfere with Site security or access data without authorization.
F. Enforcement – We may remove content, suspend accounts, or report unlawful activity to authorities at our discretion to keep the community safe.
3) User Content License & Promotional Submissions
By submitting User Content (including images, video, testimonials, or reviews), you represent that you own the content or have all required permissions (including for any child who appears). You grant EngKidz an irrevocable, perpetual, non‑exclusive, royalty‑free, worldwide licence (with the right to sublicense) to use, reproduce, distribute, publicly display and perform, adapt, modify, create derivative works from, and incorporate your User Content (including names, voices, photographs, and likenesses) into our website, products, services, educational materials, packaging, social media, digital content, and promotional campaigns. You irrevocably waive moral rights or rights of attribution to the extent permitted by law.
Promotional Submissions & Discounts- Submission does not guarantee reposting, selection, or any reward. Any discount or feature is at EngKidz’s discretion, may vary, be time‑limited, and has no cash value.
4) Consent to Electronic Messages
By registering for an EngKidz program, creating an online account, or purchasing a product, you provide your consent — as required under Canada’s Anti-Spam Legislation (CASL) — to receive electronic messages from EngKidz.
These messages may include communications about your current registration or purchase, as well as information about upcoming programs, products, promotions, offers, or events.
You may withdraw your consent at any time by following the unsubscribe instructions included in any email, or by contacting us at info@engkidz.com
4) Feedback and Suggestions
If you provide EngKidz with any feedback, ideas, or suggestions regarding our Products, Digital Content, or the Site (“Feedback”), you agree that:
- Such Feedback is provided voluntarily and without expectation of compensation or confidentiality.
- You hereby assign to EngKidz all rights, title, and interest in the Feedback, including any related intellectual property rights.
- EngKidz may use, modify, or incorporate such Feedback in any manner it deems appropriate, including product development, marketing, or service improvement.
- EngKidz will treat all Feedback as non-confidential and non-proprietary.
Please do not submit any information or ideas that you wish to remain confidential or for which you expect payment.
5) Product Safety & Supervision
A. Age & Small Parts Warning – The Products are not designed, manufactured, or intended for children under three (3) years of age and may contain small parts presenting a choking hazard. Adult supervision is recommended for all activities.
B. Safety Commitment – By purchasing or using EngKidz kits, you agree to follow all age guidance and safety instructions on packaging and in guides.
C. Limitation – In addition to other limitations below, EngKidz will not be liable for claims, damages, losses, or costs arising from use of Products by children under three (3) or use inconsistent with provided safety guidance.
Do-it-yourself Modifications and Experimental Use
EngKidz products are intended for educational use and to promote creativity through hands-on exploration. You and your child are encouraged to modify and experiment with project designs; however, such modifications are performed entirely at your own discretion and risk.
EngKidz makes no representations or warranties regarding the safety, durability, or suitability of modified projects. EngKidz shall not be liable for any loss, damage, or injury resulting from alterations to the original design, substitution of materials, use of external components, or application of excessive force or power.
Adult supervision is required at all times when children are experimenting or rebuilding. Please ensure tools and materials are used appropriately and safely.
6) Interactive Videos & Digital Learning Tools
A. Access & Use – Some kits include Digital Content (e.g., Build & Learn videos, interactive guides, simulations) accessed via QR codes, links, or accounts. Digital Content is for personal, non‑commercial educational use. Do not copy, record, download, repost, or publicly display without permission.
B. Supervision – Digital Content is designed for child‑friendly use under adult supervision. Interactive activities may include prompts or quizzes; personal information is not required to view content.
C. Accounts & Data – If you create an account to access features, you agree to keep credentials confidential. We may collect limited non‑personal usage data (e.g., viewing duration, progress) to improve learning. We do not knowingly collect personal data from children under 13 without parental consent.
D. Updates – We may update or modify Digital Content to improve educational quality, safety, or accessibility.
E. Availability & Duration (12 Months) – Access to Digital Content is included for at least twelve (12) months from the original purchase date of the corresponding kit. After that period, continued hosting is not guaranteed and may require a new purchase or enrolment. If particular content is retired within the 12‑month window, we will make reasonable efforts to provide an equivalent replacement or updated link.
7) Downloadable Guides & Educational PDFs
Downloadable Content supports hands‑on learning (e.g., guides, activity sheets, safety instructions) and is for personal, non‑commercial educational use only. You may print for personal or classroom use, but may not copy, modify, distribute, or resell without permission. All text, images, graphics, and layouts are owned by EngKidz. A typical notice may appear as: © 2025 EngKidz | All rights reserved | For personal, non‑commercial educational use only. Activities are designed for use under adult supervision. By using these materials, you acknowledge EngKidz assumes no liability for injuries or damages from misuse of tools, parts, or materials. Some PDFs contain QR codes/URLs linking to Digital Content for personal educational use; do not repost or share links publicly without permission.
8) Pricing, Payment & Orders
A. Pricing – Prices are in Canadian dollars (CAD) and may change without notice. Applicable taxes and shipping are added at checkout. Payment is due at purchase.
B. Orders – Placing an order is an offer to buy, subject to our acceptance. An order is accepted only when we send a shipping confirmation and tracking details (for all or part of your order). We may accept, decline, or cancel orders for any reason (e.g., availability, pricing errors, payment authorization) and may request verification. If we cancel all or part of an order, your sole remedy is a refund/credit for the cancelled portion (or no charge if not processed).
9) Shipping Policy
We currently ship only within Canada. Orders typically process in 2–4 business days. Delivery times vary by location and courier. Tracking will be provided. We are not responsible for delays due to carriers, weather, or other factors beyond our control.
10) Returns & Refunds
A. Damaged/Missing Parts – Contact us within 14 days after shipment; we’ll replace, or refund once confirmed.
B. Unopened Returns – Unopened kits may be returned within 30 days of purchase in original packaging with proof of purchase.
C. Eligibility Exceptions – Not eligible: final sale/clearance items; bulk/classroom discounted orders; digital downloads/online content; kits received >30 days after purchase.
D. Condition – Returns must be unused and complete with all parts and packaging; otherwise, we may decline or return to sender.
E. Exchanges – We do not accept exchanges.
F. Refund Method – Refunds are made to the original payment method after inspection. Buyer pays return shipping except for damaged/defective items.
G. Sole Remedy – Exclusive remedy for damaged/defective/missing‑part items is replacement, or refund (at EngKidz’s discretion).
H. Procedure – Email support@engkidz.com for authorization and instructions before sending a return.
11) Limited Warranties & Disclaimers
The Site, Services, Digital Content, Downloadable Content, and related materials (“EngKidz Materials”) are provided “as is” and “as available,” without warranties or conditions of any kind. To the fullest extent permitted by law, EngKidz disclaims all warranties, including merchantability, fitness for a particular purpose, title, non‑infringement, accuracy of data, uninterrupted/error‑free operation, and freedom from harmful components. Any download/upload via the Site, QR codes, or related services is at your own risk; you are responsible for device protection and data backups. EngKidz does not guarantee the security of information transmitted online and does not warrant or endorse third‑party websites/services linked through the Site. No representation is made that the Site or Services provide comprehensive or error‑free information; we may filter, modify, or remove content, links, or materials at any time without notice.
12) Release & Indemnity
To the fullest extent permitted by law, you — and, where applicable, your child or any minor under your supervision who uses our Products or Services — hereby release and forever discharge EngKidz, its parent company, affiliates, officers, directors, employees, contractors, licensors, suppliers, and partners (collectively, the “Released Parties”) from any and all claims, demands, losses, damages, liabilities, costs, or causes of action (including for personal injury, property damage, or economic loss) arising out of or relating to:
(a) your or your child’s use or misuse of our Site, Products, or Services;
(b) your or your child’s User Content, including any materials uploaded, posted, or shared;
(c) your reliance on any information or materials made available through the Site; or
(d) any interaction, transaction, or dispute between you (or your child) and any third party (including other users or linked websites).
You agree to indemnify, defend, and hold harmless the Released Parties from and against any third-party claims, liabilities, losses, damages, judgments, costs, and expenses (including reasonable legal and accounting fees) arising out of or related to:
(i) your or your child’s breach of these Terms;
(ii) your or your child’s misuse of the Site, Products, or Services; or
(iii) your or your child’s violation of any law or rights of a third party.
This indemnity obligation survives termination of your use of the Site or Services.
Nothing in this section limits or excludes any non-waivable consumer rights or remedies available to you under applicable law.
13) Limitation of Liability
To the fullest extent permitted by law, EngKidz is not liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability for any claim will not exceed the amount you paid for the Product giving rise to the claim.
Force Majeure
EngKidz shall not be liable for any delay or failure in performance of its obligations under these Terms or in providing Products or Services if such delay or failure arises from causes beyond its reasonable control. These causes may include, but are not limited to, acts of God, natural disasters, fires, floods, epidemics, pandemics, wars, terrorism, civil unrest, embargoes, labour disputes, supply-chain interruptions, power failures, internet outages, or the actions or omissions of third-party carriers or service providers.
In such circumstances, EngKidz’s obligations will be suspended for the period of the disruption, and we will use commercially reasonable efforts to resume performance as soon as practicable. Nothing in this section limits your statutory rights under applicable consumer-protection law.
14) Modifications to Terms & Services
A. Terms. We may update these Terms from time to time. If we make material changes, we will post the updated Terms (and update the Effective Date) and may notify registered users by reasonable means. Unless otherwise stated, changes take effect 30 days after posting. Continued use after the effective date means you accept the revised Terms.
B. Services. We may modify, enhance, or discontinue any aspect of the Site, Products, or Digital Content. If a change materially affects a paid subscription or pre‑order, we will offer a pro‑rata refund or equivalent credit where applicable.
15) Compliance & General Terms
You agree to comply with all applicable federal, provincial, and local laws and regulations. Failure to enforce a provision is not a waiver. If any provision is invalid or unenforceable, the remainder remains in effect and a valid term reflecting the original intent will be substituted. Headings are for convenience only. “Including” means “including without limitation.” These Terms are the entire agreement regarding your use of the Site and Services. You may not assign your rights/obligations without EngKidz’s written consent.
16) Governing Law & Venue
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Disputes will be resolved in the courts of British Columbia, subject to any non‑waivable consumer rights.
